No, EB3 ROW can use all the available EB3 ROW numbers. But the unused EB2 (ROW/Mex/Phil) have been distributed to the oversubscribed countries.
That's how I interpret that.
The popular belief was that the unused EB2 ROW would first go EB3 ROW but according to this they actually go to the oversubscribed countries in the same category (EB2)
If EB2 quota stays at EB-2 and EB-1 quota goes to EB-2 if unused. That really benefits EB-2 India/China and will hurt all the EB-3 filer. I can see many EB-3 filer, no matter they are China/India/RoW may want to interfile and upgrade to EB-2. I wonder if USCIS do this in purpose to make extra revenue? If there are 30% of EB-3 filer try to file EB-2 again, USCIS can really make some bucks out. :eek:

there. They can easily be placed by the consultancies.
SOme others pay these consultancies for sponsoring H1b visa. Typically

companies to take the call,if at all they feel that the client will
find out from the phone number which company does this phone number
belongs to, but most of the client companies don't go that far too, so
a guy's mobile number who is working in the consultancy itself can be
given as referencees contact number). It is hard to remember the voice
by the interviewer after a few days of the intrview and usually these
candidates join at least after a week after taking the interview (even
if the candidate joins in 3 days, its hard to remember the voice as the
interviewer usually interacts with many people (particularly they being
in team lead or managerial positions)
(4) I personally know people working in Microsoft, IBM, TEK systems,
Cingular, Amazon, Accenture, Citigroup etc. This says such people are

It may be pending i140 from India data.
I just checked USCIS Processing Times Information pages.
- I140's are processed only at Nebraska and Texas; Not in Vermont and California.
- Vermont and California process EB based 485 applications. (So if the data is for 485 then there should have been columns for Vermont, California service center.)
- The table provided in the letter says "Pending EB applications from India".. in my communications with my attorney, the term "EB (visa) Application" was mostly referred to filing of i140 in EB category.

This is truly unfair where country of birth determined who gets an 'Employment' based greencard before someone else. It can only be fixed by eliminating per-country limits.
I say why stop there. Why not remove this entire nonsense of EB1 vs EB2 vs EB3 and go with a points based immigration , like they have in Canada? US immigration law is made unnecessarily complex just like their tax law.

I was just thinking about this the past couple of months and maybe we dont even need to ask for Green cards. MAYBE our approach should be "Let the H4s work". Once husband and wife can both work, the green card can take its time. Right now the Biggest problem with most people is that "my spouse cannot work!". Maybe if we lobby for h4s to be eligible to work that may solve the problem.
Now before this suggestion creates a HUGE "Dhoom", this is JUST a suggestion. The current political climate does not look like it is going to be easy in any way to put any provisions for Green card increases. Besides if the logic is "Let temporary workers be temporary", this approach fits in with that logic, coz we are not asking for GCs (permanent residency), just more temporary EADs.
This is a blatant violation of what IV stands for. When you are asking for your spouse to work, you are indirectly saying that it is your priority instead of a GC.
So, are you just interested in making more money or getting a GC? If you are interested in your spouse working, it indicated you want to make more money. This will come at a cost of IV not being able to push the GC as a priority item.
Please analyze your requests, its impact on the organization and the morale of the core team before posting such irrelevant posts. Right now, the goal of the organization is to push forward the GC agenda without getting distracted with "H-4 needs to work request".

Have to watch this one carefully. Kennedy (one of the co-sponsors of this bill) had thrown EB immigrants under the bus last year while favoring FB and illegals (in CIR). Need to be see the contents of this bill very carefully. Esp this clause from the AILA report:
"Addressing the decades-long backlogs for certain countries by raising the per-country immigration limits from 7 percent to 10 percent of total admission".
The CIR in 2007 had a similar clause, bumping up the country-limit from 7% to 10%, BUT it had another related clause that stopped rollover of visa's in the last quarter.
That would be disastrous for people from India and China as number of visas issued for the whole year will go DOWN!!
The recapture clause sounds promising , provided there is atleast an even split between EB and FB (of EB coming before FB). If they do it the other way around (like they had done in the last recapture for schedule-A nurses) then EB people will see no benefit of the recapture, and will end up losing one more quick-fix option.
Eagerly waiting for the bill text so the dissection and analysis can begin!!

�(2) UNUSED VISA NUMBERS FROM PREVIOUS FISCAL YEAR- The number computed under this paragraph for a fiscal year is the difference, if any, between--
�(A) the worldwide level of employment-based immigrant visas established for the previous fiscal year; and
�(B) the number of visas actually issued under section 203(b), subject to this subsection, during the previous fiscal year.
�(3) UNUSED VISA NUMBERS FROM FISCAL YEARS 1992 THROUGH 2007- The number computed under this paragraph is the difference, if any, between--
�(A) the difference, if any, between--
�(i) the sum of the worldwide levels of employment-based immigrant visas established for each of fiscal years 1992 through 2007; and
