i am with you. we should request that USCIS recapture unused visas!
Guys , I think this issue has been discussed lot of times.
1) USCIS do not allot immigrant visas, It is alloted by DOS.
2) DOS needs a fix in the current EB laws to capture unused visa.
3) I am not sure if we can push any change in law, given the current Iraq war quagmire.
But I hope they speed up the overall application processing times, with all the increased Fee money they will get from July 30th (by investing money on IT).

Anyone who got his wife with no exp with software dev an h1b visa from some cheat in Jersey knows what i am talking bout . My freind got his wife an H1 after showing she knew software testing even though her major was fine arts and all she was good at was web surfing

Good Questions. Would you be willing to jump into the field and start motivating people to be part of IV and be actively involved in IV Action Items?. Would you be willing to find out what is stopping people from getting involved with IV?. We are always short on Volunteers to work on IV Activities and we definately welcome newbies willing to work for this cause. We have a few highly dedicated volunteers who spend time educating other people about IV, forming state chapters, recruiting members into state chapters, organizing chapter events, raising funds and the list can go on. These volunteers have 24 hours in a day just like everyone else and they have full time jobs, families, careers, schools to attend etc. Would you be willing to go out and recruit volunteers for us?

11/16/2006: Update of Lame Duck Congress Agenda
# Report indicates that the House leaders more or lesss have determined that they will stay in session through the middle of December 2006 and hope to pass all the pending appropriation bills. Report also indicates that the appropriation bills have not moved an inch within this week because both the House and the Senate have been struggling to elect the new leaders in the both chambers. Accordingly, as we reported yesterday, we will not see any active and interesting legislative activities in the Hill until next week. It is thus obvious that the Congress may pass the Continuing Resolution at least until the middle of December 2006. If in the middle of December the Congress fails to pass all the spending bills and close the 109lth Congress after middle of December, it is likely that the Congress may pass another Continuing Resolution to fund the federal government through January 2007 and the remaining spending bills will have to be taken care of by the new 110th Congress in January 2007.
# Thus far, there is no indication of introducing Ominibus Spending bill. The report indicates that CIR may stay in limbo for the rest of the year owing to the complicated strategic interest involved in both parties as related to the 2008 national election and chances are that the discussion and debate on the CIR may not take place until the new majority party starts controlling the legislative agenda. However, we may have to wait and see whether any piecemeal legislative bills on H-1B and employment-based immigration may have any chance to make through the Lame Duck Congress as related to the spending bill legislation. Business community is actively working on this strategy and it may be the immigrants' interest not to be too vocal other than working very closely with their employers to push the Congress to help the business comnmunity. People should remember that when it comes to the legislation, the Congress may act on the constituents' voice, particularly powerful constituents' voice, but not necessarily on the immigrants' rights or privilege issues. Most of the people still survive and overcome the restrictions and stay here. Still Indian IT depends on US market. No country come to the level of US yet in technology. Companies will easily find a way for all those. Impact is not for country or Corporations but for future H1b aspirants

Hi,
I am also struck in the same situation. My Interview was done on 7th Dec and so far I did not get the passport. Vfs website says "Your passport has not been handed over to VFS. I sent an email to 'ChennaiNIV@state.gov'. Got a reply that application is under process will be processed soon.

For those who care to read...the fact that I am suggesting that people should port their priority dates before that door closes shows that I believe that people who have played by the rules (ie actually put in the 5 yrs experience or find a job with EB2 requirements) should get preference !!
I call this the plight of EB2 india because as the rules are set up, in theory, if majority of EB3 ported priority dates, then yes, EB2 with later dates would truly get the short end of the stick.
Having said that, the backlash against people like SunnySurya is unfair. From his perspective, he is right and the law grants him the right to sue if he feels so.
THe problem in these forums is that any mature discussion is not possible because any dissenting voice is soon suppressed with ad hominem attacks such as the gentlemen who wanted to buy me tickets to india.
Seriously, how much more immature can we get?

(i) initially to grant an alien nonimmigrant status described in section 1101 (a)(15)(H)(i)(b) of this title;
(ii) to extend the stay of an alien having such status (unless the employer previously has obtained an extension for such alien); or
(iii) to obtain authorization for an alien having such status to change employers.
(B) The amount of the fee shall be $1,500 for each such petition except that the fee shall be half the amount for each such petition by any employer with not more than 25 full-time equivalent employees who are employed in the United States (determined by including any affiliate or subsidiary of such employer).
(C) Fees collected under this paragraph shall be deposited in the Treasury in accordance with section 1356 (s) of this title.

effect: new H1b, renewal - but based on the above only the first renewal for any given employer, if you change employers the clock starts again. total fees $1500 + 5000 = $6500
and that is a helluva lot of moolah!

I saw some postings saying that USCIS can assume the name check is done and is OK if FBI does not get back in 6 months and thats how they managed to approve all those cases in June, is this correct?

Visa Stamped on Dec 17
Got the passport on Dec 20th.
I am still waiting for my wife's PP (interview on DEC 19th). My friend went on DEC 26th and got his on the same day....
What about you guys who are waiting for thier PPs?

H1baspirant, you should be fine..my brother was F1-OPT-H1. His interview was in ND and kept his pp. he got his pp back with stamp withiin 9 calendar days..i think you PIMS should be done. In mumbai they are asking candidates to drop pp and etc once PIMS is verified. So maybe your case is same..
i was interviewed on on Jan 14th..so far its 21st calendar day..they have my pp and i am just waiting each day..mine is H1B renewal.
